Kenneth N. Hammer is an international trade and customs attorney whose practice focuses on a wide range of international trade, customs, litigation and policy matters. Ken represents and advises publicly traded and privately owned manufacturers, exporters, and importers in antidumping (AD) and countervailing duty (CVD) proceedings before the U.S. Department of commerce (DOC) and the U.S. International trade Commission (ITC). Ken also has significant litigation experience handling and arguing appeals of AD/CVD determinations on behalf of exporters and importers before the U.S. Court of International Trade.
While Ken’s practice is firmly rooted in trade remedy counseling, he also advises companies on other regulatory compliance matters that affect cross-border trade. Ken advises importers on customs matters before U.S. Customs and Border Protection, including country of origin requirements (for marking purposes), prior disclosures, tariff classifications, and valuation rules.
Ken has also counseled a wide range of companies to develop comprehensive strategies to comply with and limit their potential exposure to additional duties imposed under the U.S. Trade Representative’s (USTR) Section 301 action in its Investigation of China’s Forced Technology Transfer and the additional duties on steel and aluminum imposed by the President pursuant to Section 232. Ken successfully has guided U.S. manufacturers and importers from industries ranging from fisheries, auto parts, and outdoor power equipment to specialty chemicals to develop strong rationales and firm support to gain exclusion from these additional duties.
In addition, Ken advised companies and industry groups in China and a government organization in Vietnam concerning the ITC’s and the USTR’s Global Safeguard Investigation of Crystalline Silicon Photovoltaic Cells and Modules.
Ken has represented clients in multiple countries and throughout multiple industries including steel and steel products, other industrial metals, chemicals, renewable energy, and seafood.
Prior to Joining Trade Pacific
Prior to joining Trade Pacific, Ken was a law clerk to the Honorable Claire R. Kelly of the U.S. Court of International Trade. Earlier in his career, Ken was a litigator in private practice at a prominent boutique law firm based in New York, NY, where he worked for seven years representing clients in a broad array of litigation matters at both the trial and appellate levels.
